PROPERTY CONFISCATION

PROCEEDS OF CRIME AND CONFISCATIONS

As one of only a handful of law firms in Perth that specialise in Criminal Property Confiscations and Proceeds of Crime matters, you can rely on us for the best defence if you’ve been served with a freezing notice or order.

CRIMINAL PROPERTY CONFISCATION ACT WA

Under the Criminal Property Confiscation Act, the WA police are able to get a freezing notice, and the WA Director of Public Prosecutions (DPP) can get a freezing order to confiscate certain property.

PROCEEDS OF CRIME ACT

The Proceeds of Crime Act allows the Federal Police to investigate, freeze and confiscate any proceeds of crime against Commonwealth Law.

FREEZING NOTICE OR FREEZING ORDER

A freezing notice or freezing order can be issued over your property if there are reasonable grounds to suspect that the property is:

  • Crime-used
  • Crime-derived
  • Owned or Controlled by a Drug Trafficker
  • Unexplained Wealth
  • Criminal Benefit

If your assets are frozen or restrained in an alleged criminal activity by you or someone else, you need specialised legal advice. We can help you resist the confiscation of your property by the WA State or the Crown. Time limits do apply for you to file an objection, so don’t waste any more time.
