WHAT IS FRAUD?

Fraud is a deliberate criminal deception intended to secure or result in a financial or personal gain. This includes falsification of documents, forgery, identity theft or the use of someone’s credit card

INTENTION TO DEFRAUD

In order to be found guilty of a fraud charge in Western Australia, the prosecution needs to prove that you have acted with the intention to defraud, or behaving dishonestly.

There are two common defences for fraud charges under the Criminal Code (WA), honest claim of right under section 22 and; mistake of fact under section 24. If you’ve been charged with a fraud offence, we can help you determine whether either of these or any other defences apply to you.

PENALTIES
